1. Acceptance of Terms
By accessing or using Clinic-Ops (online appointment booking and clinic management) or any related applications or services, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the services.
2. Description of Services
Clinic-Ops provides online appointment scheduling, doctor and clinic management, and integration with specialty applications. Related desktop applications (e.g. for dermatology or other specialties) may offer practice management, patient records, prescriptions, billing, and reports. Use of such applications may be subject to a valid license or trial as described at the time of registration.
Optional connections to Google Drive and to WhatsApp (via Meta) are described below. Those connections are off until an authorised user turns them on.
3. Eligibility and Responsibility
You must be at least 18 years old and have the authority to bind your organisation where applicable. You are responsible for keeping your account credentials confidential and for all activity under your account. You are responsible for securing any local or backup data you control, including copies you place in your own Google Drive.
4. Acceptable Use and Compliance
You agree to use the services only for lawful purposes and in compliance with applicable Indian laws, including those governing healthcare data, privacy (including the Digital Personal Data Protection Act 2023 where applicable), and professional practice. You must not use the services in violation of patient consent or data-protection laws, or in any way that could harm the systems or other users.
5. Data and Privacy
Your use is also governed by our Privacy Policy. You are responsible for ensuring that your collection, storage, and processing of patient or personal data complies with applicable Indian healthcare and data-protection regulations, including when you export, back up, record, or send that data through a third-party service you connect.
6. Google Drive
A doctor may connect their own Google account from EMR Settings. A platform administrator may separately connect a Google account for a system backup. Both use Google OAuth and the Drive scope that lets Clinic-Ops create and read only files it created.
If you connect Google Drive as a doctor:
- You choose which chart sections are backed up. Those backups are JSON files in your Google Drive and are not encrypted by Clinic-Ops. You can restore a backup into your chart. Records that are not in the file are left in place.
- If you turn on PsychOps session audio, a consultation recording is uploaded to your Google Drive when you stop the recording. The audio file is not stored on Clinic-Ops servers. Clinic-Ops keeps a link (file id and related details) on that assessment so it can be played later.
- You are responsible for the Google account you connect, for who can open that Drive, and for obtaining any consent required before you record a consultation or place patient information in Drive.
- Google's own terms and privacy policy apply to data stored in Google Drive. Disconnecting Clinic-Ops stops new uploads. Files already in your Drive remain there until you delete them.
7. WhatsApp and Meta
Clinic-Ops can send and receive WhatsApp messages through the WhatsApp Cloud API operated by Meta. A doctor may connect a WhatsApp Business Account with Meta's Embedded Signup (Facebook Login). The clinic, not Clinic-Ops, is the sender of patient messages.
You may send appointment reminders, bills, prescriptions, and similar notices. Those messages can include a patient's name, mobile number, appointment details, and the content of the document you choose to send. Some actions open WhatsApp on your device so the message is sent from your own WhatsApp app.
You must have a lawful basis, including patient consent where the law requires it, before you send personal or health information on WhatsApp. Meta's terms and privacy policy apply to messages processed by WhatsApp. Clinic-Ops does not control Meta's retention of those messages.
Service notices from Clinic-Ops may also be sent to a doctor's own mobile number on WhatsApp when that channel is enabled.
8. License and Intellectual Property
The software and documentation are licensed, not sold. We grant you a limited, non-exclusive, non-transferable license to use the services in accordance with these terms and any applicable license or trial terms. All intellectual property rights remain with us or our licensors.
9. Disclaimers
The services are provided "as is" and "as available" without warranties of any kind. We do not warrant uninterrupted or error-free operation, or that Google or Meta will remain available. The services are not a substitute for professional medical, legal, or compliance advice. You are solely responsible for the accuracy of data you enter and for your clinical and business decisions.
10. Limitation of Liability
To the maximum extent permitted by applicable law in India, we and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits, including loss of files in a connected Google Drive or failure of a WhatsApp message to be delivered. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim (or zero for free or trial use).
11. Termination
We may suspend or terminate your access for breach of these terms or for any other reason. You may stop using the services at any time and may disconnect Google Drive or WhatsApp from settings. Provisions that by their nature should survive (including disclaimers, limitation of liability, and governing law) will survive termination.
12. Changes to Terms
We may update these Terms from time to time and will post the updated terms on this page with a revised "Last updated" date. Continued use after changes constitutes acceptance of the revised terms.
13. Governing Law and Disputes
These terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
