1. Acceptance of Terms

By accessing or using ClinicOps (online appointment booking and clinic management) or any related applications or services, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the services.

2. Description of Services

ClinicOps provides online appointment scheduling, doctor and clinic management, and integration with specialty applications. Related desktop applications (e.g. for dermatology or other specialties) may offer practice management, patient records, prescriptions, billing, and reports. Use of such applications may be subject to a valid license or trial as described at the time of registration.

3. Eligibility and Responsibility

You must be at least 18 years old and have the authority to bind your organisation where applicable. You are responsible for keeping your account credentials confidential and for all activity under your account. You are responsible for securing any local or backup data you control.

4. Acceptable Use and Compliance

You agree to use the services only for lawful purposes and in compliance with applicable Indian laws, including those governing healthcare data, privacy (including the Digital Personal Data Protection Act 2023 where applicable), and professional practice. You must not use the services in violation of patient consent or data-protection laws, or in any way that could harm the systems or other users.

5. Data and Privacy

Your use is also governed by our Privacy Policy. You are responsible for ensuring that your collection, storage, and processing of patient or personal data complies with applicable Indian healthcare and data-protection regulations.

6. License and Intellectual Property

The software and documentation are licensed, not sold. We grant you a limited, non-exclusive, non-transferable license to use the services in accordance with these terms and any applicable license or trial terms. All intellectual property rights remain with us or our licensors.

7. Disclaimers

The services are provided "as is" and "as available" without warranties of any kind. We do not warrant uninterrupted or error-free operation. The services are not a substitute for professional medical, legal, or compliance advice. You are solely responsible for the accuracy of data you enter and for your clinical and business decisions.

8. Limitation of Liability

To the maximum extent permitted by applicable law in India, we and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim (or zero for free or trial use).

9. Termination

We may suspend or terminate your access for breach of these terms or for any other reason. You may stop using the services at any time. Provisions that by their nature should survive (including disclaimers, limitation of liability, and governing law) will survive termination.

10. Changes to Terms

We may update these Terms from time to time and will post the updated terms on this page with a revised "Last updated" date. Continued use after changes constitutes acceptance of the revised terms.

11. Governing Law and Disputes

These terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
